It is important to acknowledge
that prostitution is not illegal in Spain. This means that private sex
workers operate within the law, unlike pimps.
The Código Penal determines
that any individual in a superiority situation who uses violence, intimidation
or deceit in order to force an adult into prostitution, taking advantage
or their victim´s need or vulnerability, is liable to be punished with
up to four years in prison and a 12-24-month fine. This punishment also
applies to any individual who makes money through exploiting another
person, even if this is consensual.
Therefore, being a private
sex worker is not illegal, unlike using people as prostitutes.
If a person freely chooses
to prostitute themselves, they cannot be arrested. In that sense, there
can be no discrimination on the grounds of orientation or gender, whether
it be male or female prostitution. Age of consent is the sole boundary.
How to protect yourself
from an assault?
Firstly, you are recommended
to contact the police in order to identify your attacker. You must go
to hospital and request an injuries form, later on go to the police
and report the assault.
